Mykhailo Smokovych

Mykhailo Smokovych has taken an active part in the process of setting up the system of administrative courts in Ukraine; he is one of the designers of the Code of Administrative Proceedings of Ukraine. Mr. Smokovych has been working in Supreme Administrative Court of Ukraine since 2005.

In both PhD and Doctoral theses (prepared and defended successfully by Mr. Smokovych) the author presents his vision of solving the issues arising during the judicial examination of cases of administrative jurisdiction. Mr. Smokovych’s PhD thesis addressed the problem of delineation of court jurisdictions and determination of the competence of administrative courts; the topic of Doctoral thesis was “Theoretical foundations of legal regulation of hearing the electoral disputes by administrative courts”.

In the vast majority of his publications, Mr. Smokovych deals with the problems of hearing and resolving electoral disputes. He is one of the co-authors of the collective monograph “Procedural peculiarities of judicial hearing of administrative disputes concerning violations of electoral legislation” (2006); he is also the author of the following works: “Electoral Legislation of Ukraine: Status, Ways and Prospects for Improvement” (2011), “Hearing of Electoral Disputes by Administrative Courts” (2011), “Judicial Control over the Election Process as an Element of the Constitutional System for the Ensuring of Democracy in Ukraine” (2012), “Evolutionary development of procedural rules on the judicial resolution of electoral disputes” (2015), etc.

Mykhailo Smokovych will present a report “Problems of implementing international legal norms in the field of protecting the right to a fair trial in the administrative justice of Ukraine”.
